User Content

In these terms and conditions, “your user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to this website, for whatever purpose.

We support and respect the intellectual property rights of others. You are solely responsible for your own content – for its accuracy, quality, integrity and legality – and the consequences of submitting and publishing it on the platform. You must own or have the rights, licenses, consents and permissions to upload and publish content on the platform. In submitting content, or publishing on the site, you confirm that you do have these rights and that your content does not infringe any third party copyright or other proprietary rights. We expect you to have the rights to publish your content, and for it to be appropriate.

You must not upload, store or transmit content that is in itself is, or encourages behaviour that is:

• Sexually explicit or pornographic
• Violent or cruel to humans or to animals
• Hateful or discriminatory
• Exploiting of minors.
• Fraudulent or illegal, including defamation
• In violation of third party privacy rights

insightScope is not responsible for the topic or content of a review, including its accuracy, appropriateness or whether it is in breach of intellectual property rights. Please inform us if you find questionable content. We reserve the right to edit or remove any material submitted to this website, stored on servers or hosted or published upon this website. Notwithstanding our rights under these terms and conditions in relation to user content, insightScope does not, and you agree that insightScope has no responsibility to, independently monitor the submission of such content to, or the publication of such content on, this website.

By creating a user account and contributing content you grant insightScope worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content. We require this license to display user content, yours and those working together on a project, to you on insightScope website. This license also allows us to evaluate user content with the goal of improving the service provided by the platform and to complete and publish research studies related to the service provided by the platform. You understand that we do not guarantee confidentiality with respect to the content that you submit.

Relationship between Users

InsightScope is a platform where users can work together on knowledge synthesis projects, including not limited to systematic reviews. Users who sign up to assist with a project do so voluntarily and by continuing to use the site you expressly acknowledge that you have done so voluntarily. By logging in and submitting content you are giving the Project Manager and InsightScope permission to not only view and use, but ownership over the work performed and content submitted.

insightScope recognizes that there are a variety of reasons why users consider assisting with a project, including education (course work), recognition in the form of volunteer time or authorship, or payment (i.e. case, gift cards, other). The insightScope platform, its owners and operators, does not reimburse users in any way and does not and will not provide a service to mediate any such agreements. We will not entertain request to establish or manage agreements between users, and will not help resolve any conflicts that develop.

Suspension of Accounts and Projects

Users identified as Project Managers may request that a project be removed from the platform. Further we may remove a project from the platform at our sole discretion without notice or explanation.

All users are able to delete their account through their Profile and by doing so remove their ability to login, submit content and complete micro-tasks. Similarly we may inactivate an account at our sole discretion without notice or explanation.

Content submitted by the user prior to inactivation is retained as the property of the project Manager and insightScope.

Warranty and Liability

This website is provided “as is” without any representations or warranties, expressed or implied. We make no representations or warranties in relation to this website or the information and materials provided on this website. You understand that we are not liable for any direct, indirect, incidental, special, consequential or exemplary damages, costs and expenses, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from:

• the use or the inability to use the platform;
• the content posted on the platform;
• unauthorized access to or alteration of your content;
• statements or conduct of any third party on the platform;
• or any other matter relating to the platform.

Nothing on the website constitutes, or is meant to constitute, advice of any kind.

Indemnity

You hereby indemnify, defend and hold harmless Dayre McNally, Algonquin Children’s Hopsital of Eastern Ontario – Ottawa Children’s Treatment Centre (CHEO) and the CHEO Research Institute from and against any and all losses, damages, costs, debts, claims, suits, proceedings and expenses incurred arising from:

• your use of and access to the platform;
• your violation of any term of these terms of use
• your violation of any third party right, including without limitation any copyright, property, or privacy right;
• any claim that your content caused damage to a third party.

This defense and indemnification obligation will survive these terms of use and your use of the platform.

Unenforceable Provisions

If any provision of this website disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.

Change to Terms

We may revise these terms and conditions from time-to-time, at our discretion. You accept the new terms with continued use of the platform. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version. If in our opinion the modification represents a material change to the terms, we will notify you by posting an announcement.

Intellectual Property and Assignment

We may transfer, sub-contract or otherwise deal with rights and/or obligations under these terms and conditions without notifying you or obtaining your consent. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Province of Ontario, Canada.

Breaches of these Terms and Conditions

If you breach these terms and conditions in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
